This Privacy Policy describes how we collect, use, disclose, and otherwise process your information when you use the Sunny Pal mobile application, website, and other online products or services that link to this Privacy Policy (collectively, the “Services”).

By using or accessing our Services, you agree to the collection, use, and disclosure of your personal information as described in this Privacy Policy, our Terms of Service, and any other documentation referenced herein. If you do not agree with these policies and practices, you should not use or access our Services.

AI Processing Notice: Sunny Pal uses Google Gemini to process certain optional image submissions and plan-generation requests. Those features are not processed only locally on your device. When you submit an image or create a plan, the information needed to complete that request is transmitted to Sunny Pal servers and Google Gemini solely to generate the requested response. We do not sell this information, use it for advertising or tracking, or store submitted images, Gemini prompts, or Gemini responses as persistent cloud records after the response is returned.

1. Information We Collect

1.1 Personal Information

We may collect personal information that you voluntarily provide to us when you register for an account, contact us, or otherwise interact with our Services. This information may include:

• Contact Information: Such as your name, email, and phone number.
• Account Credentials: Passwords, user IDs, or other authentication details that you create to access the Services.
• Profile Details: Appearance-related settings, reminder preferences, outdoor activity preferences, and other information you provide to personalize your experience.
• Plan and AI Inputs: Information you choose to submit when creating a plan or using AI-assisted features, such as reminder settings, app preferences, notes, selected UV or weather context, location context if enabled, and images you choose to submit.
• Payment Information: If you choose to purchase a subscription or any paid feature within our Services, we may collect billing details such as credit card numbers and billing addresses; however, payment processing is typically handled by third-party payment processors, and we do not store full payment card numbers.

1.2 Automatically Collected Information

When you use our Services, we automatically collect certain information about your device and usage, which may include:

• Device Information: Your device model, operating system, unique device identifiers, and IP address.
• Location Data: Geolocation data (if you grant permission) to provide UV index or weather information related to your location.
• Usage Data: Information about how you use our Services, including session times, page views, in-app interactions, crash reports, and other analytics data.
• Cookies and Similar Technologies: We may use cookies, web beacons, and similar tracking technologies to collect information about your interactions with our Services and to remember your preferences. You can manage cookie preferences through your browser settings. Disabling cookies may affect some features of our Services.

1.3 Photos, Plan Inputs, and Google Gemini Processing

If you choose to use any camera or photo upload features (for example, to provide a photo-based appearance estimate) or if you create a plan using AI-assisted features, Sunny Pal may send the image, prompt, relevant app settings, and selected UV, weather, or location context to Google Gemini through our servers. This processing is used only to generate the requested appearance estimate, plan, reminder content, or related response.

We use a billing-enabled Google Gemini API configuration for production AI features. Under Google's paid Gemini API terms, Google states that prompts, associated instructions, files such as images, and responses are not used to improve Google products. Google may still process, transiently cache, or retain limited API logs for service operation, abuse monitoring, security, or legal and regulatory compliance as described in Google's applicable terms and policies.

Sunny Pal does not store submitted images, Gemini prompts, or Gemini responses as persistent cloud records after the requested response is returned. Temporary transmission data may exist briefly as needed to operate, secure, and troubleshoot the Services. We do not use submitted images or plan-generation inputs to train our own machine learning models, and we do not use them for advertising or tracking.

2. How We Use Your Information

We use the information we collect for various business and operational purposes, including to:

• Provide, maintain, and improve our Services, such as providing UV index information, weather-based reminders, SPF prompts, timer reminders, photo-based appearance estimates, appearance tracking, and managing user accounts.
• Process optional images and plan-generation inputs through Google Gemini to return the appearance estimate, plan, reminder content, or response you requested.
• Limit AI-related processing to app functionality. We do not sell submitted images, plan inputs, Gemini prompts, or Gemini responses, and we do not use them for third-party advertising, cross-app tracking, or training Sunny Pal machine learning models.
• Communicate with you about your account, updates, promotions, and marketing messages (if you opt in), including sending you emails, push notifications, or other communications.
• Process transactions, including subscription payments and any other paid features you may choose to purchase.
• Analyze usage and performance data to improve the quality and reliability of our Services.
• Detect, prevent, or address technical issues, security breaches, or fraudulent activity.
• Comply with applicable laws, regulations, or legal processes.
• Enforce our Terms of Service and other agreements, or as otherwise described at the point of collection.

3. Marketing Communications and Consent

By creating an account or otherwise providing us with your email address or contact information, we may send you service-related communications, such as account, subscription, security, support, and transactional messages. We may send marketing communications where permitted by law and, where required, with your consent. You can opt out of receiving marketing emails by following the unsubscribe link provided in those emails, adjusting your account preferences, or contacting us directly. Even if you opt out of certain marketing communications, we may still send you non-promotional messages regarding your account or transactions with us.

4. Sharing and Disclosure of Information

We do not sell your personal information to third parties. We may share or disclose your personal information in the following circumstances:

• Service Providers: We may share information with third-party vendors, consultants, and service providers who perform functions on our behalf, such as payment processing, data hosting, customer service, analytics, or email delivery.
• Google Gemini: When you submit an image or create a plan using AI-assisted features, we share the information needed to complete that request with Google Gemini so it can generate the requested response. Google Gemini is used as a service provider for app functionality, not for Sunny Pal advertising or tracking.
• Business Transfers: We may share or transfer information in connection with, or during negotiations of, any merger, sale of assets, financing, or acquisition of all or a portion of our business by another company.
• Legal Obligations: We may disclose your information if required to do so by law or in response to a valid subpoena, court order, or governmental request.
• Protection of Rights: We may disclose your information to protect our rights, property, and safety, or those of our users or any other person, and to enforce or defend our legal rights, including our Terms of Service.
• Consent: We may share your information with your consent or at your direction.
• Aggregated or De-Identified Data: We may also share aggregated, anonymized, or de-identified information that cannot reasonably be used to identify you.

We do not sell your photos, plan inputs, Gemini prompts, or Gemini responses. We do not share them with data brokers or advertising networks.

5. Data Security and Retention

We use appropriate technical and organizational measures to protect the personal information we collect from unauthorized access, use, alteration, and disclosure. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

We will retain your information for as long as your account is active or as needed to provide you the Services. We will also retain and use your information as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and protect our legal rights.

For optional image and plan-generation features, Sunny Pal does not retain submitted images, Gemini prompts, or Gemini responses as persistent cloud records after the requested response is returned. Google may retain limited API logs for a limited period for abuse monitoring, security, service operation, or legal and regulatory compliance under Google's applicable terms. If you save a plan, reminder, note, or appearance-tracking item in the app, that saved item may remain available on your device or account until you delete it or request deletion, subject to backup, security, legal, and dispute-resolution retention needs.

6. International Transfers

Your information may be transferred to and processed in countries other than the country in which you are a resident. We take steps to ensure that your information receives an adequate level of protection in the jurisdictions where we process it.

7. Children's Privacy

Our Services are not directed to individuals under 13 years of age. We do not knowingly collect personal information from children under 13. If you become aware that a child has provided us with personal information, please contact us at support@getsunnypal.com. If we learn that we have collected personal information of a child under 13, we will take steps to delete such information.

AI-assisted features that use Google Gemini are intended for adults and are not directed to children. Do not submit photos of children or other people without appropriate permission.

Informational Use Only: Sunny Pal provides informational UV index, weather, timer, SPF prompt, reminder, and photo-based appearance estimate features. The Services are not intended to be a substitute for professional medical advice, diagnosis, or treatment. You should always seek the advice of a qualified healthcare provider before making medical or health-related decisions.

Not Medical Advice: Sunny Pal is not a medical service, healthcare provider, dermatologist, or medical device. The Services do not diagnose, treat, monitor, cure, or prevent sunburn, skin damage, skin cancer, or any other medical condition. Sunny Pal does not provide medical, dermatology, or professional sun-safety advice.

No Guarantee: Sunny Pal does not guarantee any visible appearance change, sunburn prevention, or health outcome. UV index, weather, reminder windows, and photo-based appearance estimates may be delayed, unavailable, incomplete, or inaccurate. You are responsible for checking local conditions, using your own judgment, and consulting a qualified healthcare professional before making medical or health-related decisions.

9. App Store Privacy Disclosures, Tracking, and Consent

Our App Store privacy responses are intended to accurately describe the data handled by Sunny Pal and our service providers, including Google Gemini. Depending on which features you use, relevant App Store data categories may include contact information, identifiers, location, user content such as photos, app activity, diagnostics, and other data you choose to provide for app functionality.

Sunny Pal does not use submitted images, plan inputs, Gemini prompts, or Gemini responses to track you across apps or websites owned by other companies. We do not share those materials with data brokers. Where required by the operating system, we request permission before accessing device features such as camera, photos, or location.

10. Your Rights and Choices

Depending on your jurisdiction, you may have certain rights regarding your personal information. These may include the right to access, correct, or delete your information, the right to restrict or object to certain processing, and the right to data portability. You may choose not to use optional image or AI-assisted plan-generation features. You may also delete saved app content where the app provides deletion controls or contact us to request deletion of personal information associated with your account.

We reserve the right to modify or update this Privacy Policy at any time. If we make any material changes, we will notify you by email (if we have your email address) or by posting a notice within the Services prior to the change becoming effective.
